Intra-company Transferees that Qualify for Work Permits

Currently work for a multinational company.
Intend to work in a parent, subsidiary, branch, or affiliate of that enterprise.
Transfer to an enterprise with a qualifying relationship.
Engage in employment at a legitimate and continuing establishment.
Move to a position in an executive, senior managerial, or specialized knowledge capacity.
Maintain continuous employment for at least one year within the three-year period before the initial application.
Possible extensions up to the five- and seven-year maximums with "recaptured" time spent outside Canada during the work permit's duration.
Are coming to Canada for a temporary period only.
Comply with all immigration requirements for temporary entry.

Work Permit Duration

Initial permit: one year.
Renewals require evidence of:
Continuation of qualifying relationship between Canadian and foreign companies.
Continuous provision of goods or services by the new office for the past year.
Staffing of the new office.

Documentation Requirements

Proof of current employment with a multinational enterprise outside Canada.
Confirmation of continuous full-time employment in a similar position for at least one year in the preceding three years.
Description of the applicant's executive or managerial role, or specialized knowledge.
Evidence of specialized knowledge and its requirement for the Canadian position.
Description of the Canadian position, including title, responsibilities, and duration.
Intended duration of stay.
Description of the relationship between the Canadian and foreign enterprises.

Recaptured Time
To calculate the five- or seven-year limit for intra-company transferees, the work permit’s duration is typically used. However, any documented non-working time during the permit’s validity can be “recaptured.” This ensures intra-company transferees have a full five or seven years of physical presence in Canada.
